These terms cover your use of First 8 Seconds, at thefirsteightseconds.com and portal.thefirsteightseconds.com, run by TWEAK LLC, a Utah company. Creating an account means you agree to them.
What you are buying
An audit of one landing page, the page address you give us, delivered as a report in the portal. The report is our professional opinion on how the page performs in a visitor's first seconds, with recommendations. It is advice. We do not promise any change in your traffic, conversions or revenue.
Turnaround
We aim to deliver within 2 business days of your audit entering our queue, which is when you pay for it or apply a credit to it. Business days are Monday to Friday. If we cannot reach your page or need something from you, the audit pauses and we email you; the clock stops while it is paused.
Price and payment
The price is shown at checkout and charged when you order, through Stripe. A bundle buys a set number of audits; the ones you have not used are credits you can spend on other pages later. Credits do not expire.
Cancelling and refunds
You can cancel an audit yourself from its page as long as it is still queued and we have not started on it. The credit goes back on your account; email us if you would rather have a refund. Once work has started, email us; whether we refund is our call, based on how much has been done. Delivered reports are not refundable.
If we cannot complete your audit, we refund it in full.
Your account
One person per account. Keep your password to yourself; what happens under your sign-in is your responsibility. You must be 18 or over and using the service for a business.
Only order audits of pages you own or are authorized to have reviewed.
Your report
The report is yours to use for your business, share with your team, and act on. We keep the right to use what we learn from audits, without identifying you or your company, to improve the service.
Ending things
You can delete your account from the Account page once nothing is in progress: cancel any queued audit first, and if we have started on one, or you hold unused credits, email us so we can cancel or refund before you delete. Deleting removes your reports, so download what you want to keep.
We can close an account that breaks these terms or is used to abuse the service, and we will refund any audit we have not started and any unused credits.
Limits
The service and the report are provided as they are, without warranties beyond what the law requires. To the extent the law allows, we are not liable for indirect or consequential loss, and our liability to you for anything arising from the service is limited to what you paid us for the audit in question.
Law
These terms are governed by the law of Utah, and disputes go to the courts of Utah County.
Changes
We may update these terms. The date at the top changes when we do, and we will email account holders about changes that matter.
